Supreme Court rules strip-searching allowed for any arrest

Posted on Tuesday, April 3rd, 2012 at 3:21 pm

The Supreme Court made a ruling on Monday that states that strip-searching is allowed for anyone arrested before they are admitted to jail. The strip-searching can be done on a detainee when they are arrested for any offense even if police do not have a suspicion that the person is carrying contraband.

The 5-to-4 vote passed the bill into law and it states that the courts do not have the power to prevent correctional facility employees from checking to make sure if a detainee is carrying illegal substances, weapons or information related to gangs and public health, by forbidding them to strip-search the detainee.

The Supreme Court decision does make the strip-searches a requirement, but they are now allowed. This means that the Fourth Amendment, which discusses illegal searches, does not prohibit employees from strip-searching. The minority opinion on this decision has stated that the new law violates “human dignity and individual privacy.”
